KELLER FARMS PUPPY SALES CONTRACT

Keller Farms and the Buyer, __________________________________________, hereby agree as follows:

Please be aware deposits for holding a specific puppy are non-refundable unless said puppy is not deliverable, deposits received go towards the selling price of the puppy.

1. The Seller hereby sells to the Buyer, for the amount of $____________, payment of which is hereby acknowledged, a male/female ___________ puppy, microchip #_______________________________, born _______________________, by ___________________, out of ________________, in accordance with the terms of this contract. All shipping fees are separate from payment or cost of puppy and contingent on form of transportation at time of purchase.

2. The Buyer can register the puppy with the American Kennel Club under a name of their choosing; buyer is responsible for all registration fees. Micro chipping of the puppy is provided free of charge by Keller Farms with recommended national registry with the AKC CAR (companion animal recovery) program.

3. The Seller guarantees that the puppy is in good health at the time of shipping. The Buyer has the right to return the puppy to Keller Farms at the Buyers expense within three days after delivery and receive a replacement puppy of equal or greater value if the puppy is found by a veterinarian to be suffering from any disease. Puppy MUST see a licensed veterinarian within 3 business days of arrival to verify health of the puppy. Documentation of veterinarian exam is required before any returns or compensation will be issued.

4. The Seller guarantees that the puppy is free of hereditary defects to the best of his/her knowledge until the puppy is one year of age; after which time Keller Farms does not assume any additional liability for possible defects in the puppy, and will under no circumstances be responsible for veterinary bills resulting from any such condition. 5. The puppy shall not be guaranteed to breed unless a separate breeder contract is agreed upon.

6. The Buyer shall maintain the puppy in good condition, including adherence to a regular immunization schedule, heartworm preventative, regular worming, good diet, and a clean and safe environment.

7. If at any time in its life the puppy is to be given away, or submitted to a shelter the Buyer shall so notify Keller Farms and be given the first option of first refusal or assistance in re-homing.

8. If at anytime the Buyer sells the puppy, to any individual or establishment in the business of buying and selling puppies Keller Farms shall not be held liable for any health issues or veterinarian expenses for the puppy and any guarantee shall be null and void.

9. Buyer and Keller Farms agree that this Agreement, its terms and conditions, will be governed by the laws of the State of Missouri and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Keller Farms. If any part of this contract requires legal action in order to compel enforcement, resolve a dispute or secure a judgment, buyer agrees that venue shall lie in Dallas County Missouri.
